Jokey© Terms and Conditions of Use

Welcome to Jokey© ("we", "us", "our"). By accessing or using our mobile application and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

1. Eligibility

You must be at least 13 years old to use the Service. If under 13, you must obtain a parent or guardian's permission before using the Service.

2. User Accounts

• You must register an account to use certain features of the Service.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate and current information and to keep it updated.

3. User-Generated Content

You retain ownership of any content (photos, videos, captions, etc.) you share via the Service ("User Content"). By uploading or posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute your content to operate and improve the Service.

• You represent you have the necessary rights to post the content.
• Your content must comply with applicable laws and these Terms.

We reserve the right to remove content that violates our policies or is harmful to users.

4. Prohibited Conduct

• Posting or sharing illegal, abusive, violent, pornographic, or discriminatory material.
• Impersonating others or misrepresenting your identity.
• Harassing, stalking, threatening, or abusing other users.
• Using the Service for spam, phishing, or unauthorized advertising.
• Reverse-engineering, tampering with, or copying the app or related systems.

5. Monetization Policy

As Jokey© evolves and grows its user base, we aim to offer revenue-sharing opportunities to eligible users. This may include:

• A potential share of advertising revenue earned from ads shown on or near your content
• Possible payouts based on content reach, views, or engagement metrics

Monetization is not guaranteed and is subject to:

• The app reaching a sufficient user base and advertising revenue threshold
• Future eligibility requirements and program terms to be determined
• Compliance with community guidelines and local laws

We reserve the right to modify, suspend, or cancel monetization features at any time. Details about revenue share percentages, minimum payout thresholds, and eligibility will be made available in the app or via official communication once monetization is formally launched.

6. Joker Badge and Recognition Policy

As part of Jokey©’s creator recognition system, we award users who achieve high impact with their content. The general milestone for the Joker badge is:

• 10,000,000 total "laughter" reactions across a user's content.

The Joker badge appears next to the user’s display name throughout the app and serves as a symbol of influence and verification.

Benefits:

• Increased exposure and discoverability across feeds, trends, and featured content
• Priority eligibility for enhanced monetization offers, brand collaborations, and experimental features
• Access to upcoming tools and features exclusive to top creators

Important Notes:

• All reactions must be legitimate and earned in compliance with Jokey©’s content and conduct policies
• Users may lose the Joker badge if found violating community standards, Terms of Use, or engaging in manipulation (e.g., fake likes, bot engagement)
• Jokey© reserves the right to award, revoke, or modify Joker badge eligibility criteria or benefits at any time

7. Privacy and Data Protection

Your data is handled according to our Privacy Policy. In short: we do not sell your data, and we do not use cookies or device identifiers for advertising or cross-app tracking. See the Privacy Policy for full details and your GDPR/CCPA rights.

8. Push Notifications & Consent

By enabling push notifications, you consent to receive alerts related to app activity (likes, comments, follows, etc.). You can disable notifications at any time in your device settings.

9. Advertising Policy

To support the Service and creator rewards, Jokey may display ads (banners, interstitials, video, sponsored content, or in-feed placements). Currently, ads shown in Jokey are not personalized using tracking across other apps or websites. If we introduce personalized advertising in the future, we will request your permission using Apple’s App Tracking Transparency (ATT) framework before enabling such tracking-based personalization.

Users who violate Terms or manipulate engagement may lose eligibility for monetization or recognition.

10. Content Moderation and Account Suspension

• We may remove content that violates these Terms.
• We may suspend or terminate accounts for serious or repeated violations.
• We will cooperate with legal authorities if required by law.

11. Intellectual Property

All app content (excluding User Content), including names, badges, logos, icons, and UI, are owned or licensed by El Hussain El Sayed and are protected by copyright and trademark laws. Do not copy or reproduce without permission.

12. Third-Party Services

The Service may include links to third-party services. Jokey is not responsible for third-party content, policies, or practices.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violations. Upon termination, content may be removed or anonymized and certain data may be retained as required by law or our Privacy Policy.

14. Limitation of Liability

To the extent permitted by applicable law, Jokey is not liable for loss of data, revenue, access, or other damages arising from use of (or inability to use) the Service, or for content posted by users.

15. Indemnity

You agree to indemnify and hold harmless Jokey, its affiliates, employees, and partners from claims or liabilities arising from your use of the Service or violation of these Terms.

16. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the app or email. Continued use of the Service after updates constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of Dubai, United Arab Emirates. Disputes shall be resolved in the courts of Dubai, UAE.
